On April 13, 2005 the President's Cabinet passed the following amendment to the Defined Contribution Retirement Plan (DCRP) to be effective July 1, 2005. This amendment pertains only to PERA retirees who return to work as faculty or exempt staff for the College after beginning PERA retirement. These employees will be enrolled in the DCRP and the following amendment concerning contribution rates shall apply. AMENDMENT TO

FORT LEWIS COLLEGE

DEFINED CONTRIBUTION RETIREMENT PLAN (DCRP)

            The Fort Lewis College Defined Contribution Retirement Plan (DCRP) Plan Document (the “Plan”) is hereby amended as follows:

ARTICLE 3    (Employer Contributions-Section 3.1) is amended and restated effective as of July 1, 2005 to read as follows:

            Section 3.1 – Employer Contributions     The Employer shall contribute to the Plan 11.4% (11.6% prior to July 1, 1998) of Covered Earnings of each Eligible Employee.

     FOR COVERED EARNINGS PAID ON OR AFTER JULY 1, 2005 TO A PERA RETIREE (AS DEFINED IN ARTICLE 51 OF TITLE 24 OF THE COLORADO REVISED STATUTES) WHO IS HIRED OR REHIRED BY THE EMPLOYER ON OR AFTER JULY 1, 2005, THE EMPLOYER CONTRIBUTION UNDER THIS SECTION 3.1 SHALL BE REDUCED BY ANY AMOUNT THE EMPLOYER IS REQUIRED TO CONTRIBUTE TO THE COLORADO PUBLIC EMPLOYEES RETIREMENT ASSOCIATION WITH RESPECT TO THE PARTICIPANT.

            However, the Employer’s Contribution for any Plan year shall be subject to the limitations on allocations in Article 6.
