Fort Lewis College Mobile Application Policy and Terms and Conditions of Use

Last update 2/1/2021

As a public institution, Fort Lewis College (FLC) values diversity, equity, and inclusion.  Moreover, our mission and values are based on dignity and respect for all community members.   It is with this approach that we encourage all users of the FLC Mobile Application (App) to understand and agree to the Ready Education Privacy Policy and Terms of Service and the FLC terms and conditions discussed below.

During the COVID-19 pandemic, the FLC Mobile App is the primary tool for reporting daily health screening, tracking contact locations, and disseminating official health related notifications. All members of the FLC community shall use the FLC Mobile App to complete a daily health screening and check their notifications before coming to campus and to scan QR codes located on campus in order to facilitate contact tracing in the event of positive COVID-19 exposure within the FLC community. Moreover, you may be notified through the FLC Mobile App for mandatory or voluntary COVID-19 testing. If you have been identified as being exposed to COVID-19, you will receive notifications through the FLC Mobile App with instructions on how to proceed with precautionary measures.

In addition, the FLC Mobile App allows FLC students, faculty, and staff to optionally engage with one another, and receive and exchange information about FLC and the FLC community.  When posting to the FLC Mobile App channels/walls, you will not be anonymous. All posts are identified with your profile name and are viewable by all members of the FLC community.   Your profile name cannot be changed, which  is your last name and preferred first name registered with FLC. Another feature of the FLC Mobile App is the exchange of private messages between users – you are not anonymous when sending private messages. Users of the FLC Mobile App have the option to block private messages from other users.

Through your user profile, you have the option to turn on and off notifications from channels.  Essential or urgent notifications from FLC will always be delivered regardless of your channel setting.

All conduct on the FLC Mobile App, whether it be public postings, comments, or private messaging, is subject to, and must abide by, all FLC Policies, including but not limited to, the Student Conduct Policy, Sexual Harassment/Misconduct Policies & Procedures, Discriminatory HarassmentGrievance Procedure, Acceptable Use of Information Technology Policy, as well as all Federal, State and Local laws. Reporting campus policy violations, sexual misconduct and/or issues of safety should be done through the FLC Tell Someone website. Or, for immediate emergencies, call 911.

Posting confidential information as defined by, including but not limited to, the Family Educational Rights and Privacy Act (FERPA), Health Insurance Portability and Accountability Act (HIPAA), and National Collegiate Athletic Association (NCAA) Regulations, is not allowed and will be removed by FLC as soon as practically possible upon discovery.

FLC is dedicated to fostering an educational environment that allows for freedom of speech and expression under the First Amendment to the U.S. Constitution. However, FLC reserves the right to remove, without notice, any posts or comments that lose First Amendment protection, such as any unlawful, defamatory, or obscene (as defined by state or federal law) posts or comments.   However, as a reminder, heated and pointed disagreements, political opinions, and even some content that may be deemed as “hateful” by some, could fall within First Amendment protection.

The FLC Mobile App is not actively monitored or moderated by FLC. The FLC Mobile App has a built-in moderation feature, which allows users to flag posts or comments as inappropriate. Under this feature, when a post or comment receives four flags, it is automatically removed from viewing, along with any sub comments. If a user wishes to seek review of the removal of his or her post under this built-in moderation feature, the user must submit a request through the App within three business days of the post’s or comment’s removal. The post or comment will then be reviewed by the Office of Student Affairs or their designee who will decide whether to approve the post or comment, or to keep it removed from viewing. The decision is final and not subject to appeal.

Posts and comments by users on the FLC Mobile App do not reflect the opinions or policies of FLC. Under section 230 of the Communications Decency Act, FLC shall not be treated as a publisher or speaker of content posted on the FLC Mobile App.

Think twice (or even three times) before posting, as whatever you post is forever linked to your name. FLC encourages you to be respectful, be inquisitive, ask questions, help each other, and have fun. Be a Skyhawk; we’re in this together.
